Terms of Service

By downloading, installing, or using Hijopet (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App.

These Terms form a legal agreement between you and Hijopet, a personal, non-profit project. By accepting these Terms, you confirm that you are at least 13 years old.

Hijopet is a pet photography app that lets you take, edit, and save photos and videos of your pets. The app runs primarily on your device — your photos and pet profiles are never stored on our servers.

Features include attention sounds, AI-powered auto-shutter, pet profiles, birthday reminders, and photo editing tools.

Price: the app is free and complete, with no subscriptions or charges. If we ever offer an optional paid feature, it will be charged only through Google Play or the Apple App Store, never by any other means inside the app.

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for personal, non-commercial purposes, subject to these Terms.

This license does not include the right to sublicense, sell, resell, or transfer the App to any third party.

The following are strictly prohibited and fall outside the scope of the license granted above:

• Reverse-engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the App.
• Automating use of the App through bots, scripts, or other unauthorized means.
• Redistributing, reselling, sublicensing, or sharing the App or any modified version of it.
• Using the App to build or improve a competing product.
• Removing, obscuring, or altering any copyright, trademark, or other proprietary notices.
• Using the App to violate any applicable law or regulation, or to infringe the rights of third parties.

Hijopet is a local-first app: your photos and videos are saved to your device gallery and are never uploaded to our servers. You are solely responsible for any content you share outside the App, whether on social media, messaging platforms, or elsewhere.

You are solely responsible for having the consent of any identifiable person appearing in your photos or videos, and for respecting their image, reputation, and privacy rights, as well as any rights in third parties' pets, property, or trademarks that may appear. This responsibility applies both within the App and when sharing content on social media, messaging platforms, or elsewhere. Hijopet assumes no liability for content you capture, edit, or share.

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We encourage you to read it — it explains in plain language what data we collect (very little) and why.

The App is provided “as is” and “as available” without warranties of any kind, express or implied, including — without limitation — implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be error-free, uninterrupted, or compatible with every device, or that photo quality will meet any specific expectations. Use of the App is at your own risk.

Beta stage. The App is in testing (beta): it may contain errors, change significantly, or be discontinued at any time, with no liability to us.

Data and backups. The data you create in the App (pet profiles, settings, notes) is stored on your device only. It may be permanently lost if you uninstall the App, change or reset your phone, or clear the App's data. Keeping backups is your responsibility (the App includes a backup feature). We are not responsible for the loss of data, photos, or settings.

Not veterinary or medical advice. The care features (weight, reminders, record, health card) are organizational and informational tools and do not constitute veterinary, medical, or professional advice. They do not replace consulting a veterinarian. For any concern about your pet's health, always consult a professional. AI-assisted features (detection, cutout, styles) may produce inaccurate results and should not be relied upon for important decisions.

To the maximum extent permitted by applicable law, Hijopet shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including — without limitation — loss of photos, loss of data, or lost profits, arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms shall not exceed the greater of the amount you paid for the App (currently zero, as it is free) and USD $50.

Nothing above excludes or limits our liability where applicable law does not allow it, nor does it affect the non-waivable rights granted to you by consumer law. The limitations in this section apply only to the maximum extent permitted by law.

Indemnification. You agree to defend, indemnify, and hold harmless Hijopet, its founders and contributors from any claim, demand, loss, or expense (including reasonable legal fees) arising from: (a) your use of the App; (b) the content you create, edit, or share with it; (c) your breach of these Terms; or (d) your violation of any third-party right.

Hijopet is a personal, non-profit project. These Terms are governed by and construed in accordance with the laws of the Republic of Colombia. Any dispute arising from these Terms shall be submitted to the competent courts of Colombia.

We may update these Terms from time to time. We will notify you of significant changes via a notice in the App at least 15 days before the changes take effect. The effective date at the top of this page shows when the current version took effect. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

We may suspend or terminate your license and your access to the App, immediately and without prior notice, if you breach these Terms, misuse or abuse the App, or where required by law. We may also, at any time and at our sole discretion, modify, suspend, or discontinue the App — in whole or in part — temporarily or permanently, with no liability to you, given that Hijopet is a free, personal, non-profit project.

You may terminate these Terms at any time by ceasing to use the App and uninstalling it. Sections that by their nature should survive — intellectual property, disclaimer of warranties, limitation of liability, indemnification, governing law, and general provisions — will remain in effect after termination.

The App is distributed through third-party stores such as Google Play and the Apple App Store, and its download and use are also subject to those stores' terms and policies. We are not responsible for the practices, availability, or decisions of those stores.

Some features (such as cutout or background removal) download, the first time you use them, an AI model file from dl.hijopet.com, served via third-party infrastructure providers. That download depends on your connection and on services we do not always control; we do not guarantee its uninterrupted availability.

The App and the website may contain links to third-party sites (for example, animal-welfare foundations). We neither control nor endorse those sites and are not responsible for their content, policies, or practices. Accessing third-party sites is at your own risk and is governed by each third party's terms.

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force, and the affected provision will be interpreted to come as close as possible to its original intent within the limits of the law.

Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Hijopet regarding the App, and supersede any prior agreement or understanding on the same subject.

No waiver. Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, to any person or entity (for example, if Hijopet is later organized as an entity), without restriction and without notice.

Force majeure. We will not be liable for any failure or delay caused by events beyond our reasonable control, including internet or provider failures, power outages, natural disasters, acts of authority, or any other force-majeure event.

Notices. We will provide notices related to the App through in-App messages or by posting them at hijopet.com. Any communication you wish to send us should go to [email protected].
